Invitation To Comment:
The Federal Trade Commission is currently accepting public comments on an application from Praxair, Inc. and Linde AG to divest certain "HyCO" assets, including on-site hydrogen and on-site carbon monoxide assets to Matheson Tri-Gas, Inc. The divestiture is required by the FTC's Oct. 22, 2018, proposed order requiring Praxair and Linde to divest certain industrial gas and helium assets to settle charges that their $80 billion merger would violate federal antitrust law.

The parties will divest to Matheson five of Linde's HyCO facilities outside the Gulf Coast region, along with Linde's hydrogen pipeline in the Gulf Coast, intellectual property, customer contracts, and other assets.

Privacy & Use:
The FTC Act and other laws the Commission administers permit the collection of public comments to consider and use in this proceeding as appropriate. All timely and responsive public comments, whether filed in paper or electronic form, will be considered by the Commission, and will be placed on the public record of this proceeding-including on the publicly accessible FTC website at, to the extent practicable. Comments containing material for which confidential treatment is requested must be filed in paper form, must be clearly labeled "Confidential," and must comply with FTC Rule 4.9(c).1 As a matter of discretion, the FTC makes every effort to remove home contact information for individuals from the public comments it receives before placing those comments on the FTC Web site.
